Notice To All Customers & Common Carriers: It is Jim’s Supply Company, Inc.’s policy for our personnel to place materials on the customer/common carrier’s vehicle as directed by the customer/common carrier’s driver. It is the customer/common carrier driver’s responsibility to inspect and secure the load for transportation as stated in the Federal Motor Carriers Safety Regulations Handbook, Section 393.100.

Conditional Sales Agreement: It is agreed that title to the above-described merchandise shall remain with the seller until fully paid for by the buyer. Risk of loss, destruction, or damage shall be with the buyer unless so stated in writing. All accounts are due and payable as per the terms listed above. Past due accounts will be subject to a Service Charge at the maximum legal rate. All returned checks will be subject to a $25.00 returned check charge.

Upon buyer’s failure to pay any indebtedness owed to Jim’s Supply Company, Inc. when due, Jim’s Supply Company, Inc. may at its option declare all indebtedness owed by the buyer to Jim’s Supply Company, Inc. immediately due and payable. In the event of insolvency of the buyer or default in payment, the Seller may enter and reclaim said merchandise, and Buyer waives all claims for damage. Repossession shall not preclude recovery of a deficiency from the buyer in event of a suit. Buyer will reimburse Jim’s Supply Company, Inc. for all expenses, attorney fees, and collection costs and fees incurred in connection with the collection of any indebtedness owed to Jim’s Supply Company, Inc. Place of contracting for the sale of these goods shall be Kern County, California.

Buyer acknowledges receipt of said merchandise in good condition. Material is sold “as is” with no implied or written guarantees or warranties. Our liability is limited to replacing the material sold. Cut material cannot be returned for credit. All other returns must first be approved by Jim’s Supply Company, Inc. office personnel and may be subject to a restocking fee.
